A.  APPLICATION OF BOOM2U’S TERMS AND CONDITIONS

 

1. By using this website, you agree that these Terms and Conditions, including our Privacy Policy, govern your use of:

• All sales conducted on the boom2u website, and
• Your purchase of products, merchandise, and/or tickets from the KRU Group.

2. By accessing or making a purchase through our website, you acknowledge that you have read, understood, and agreedto these Terms and Conditions and our Privacy Policy. This includes all terms explicitly stated here and any that are incorporated by reference.

1. Colours

We have done our best to reproduce as accurately as possible the colours of the Products shown on this Website. However, because the colours you see on the Website will depend on your monitor, we cannot guarantee that your monitor’s reproduction of any colour will be accurate.

You shall indemnify and hold boom2u and its affiliates , and their respective employees, representatives, agents, affiliates, directors, officers, managers and shareholders (collectively the “Parties”) harmless from any damage, loss, or expense (including without limitation, attorneys’ fees and costs) incurred in connection with any third-party claim, demand or action (“Claim”) brought against any of the Parties alleging that you have breached any of these terms and conditions. If you have to indemnify any of the Parties under this Section, boom2u shall have the right to control the defence, settlement, and resolution of any Claim at your sole expense. You may not settle or otherwise resolve any Claim without express written permission from boom2u. 

4. Legal Capacity To Transact

By accepting these Terms and Conditions, you represent and warrant that you are over the age of eighteen (18) years. Individuals under the age of 18 are not permitted to place orders on this website. Should boom2u incur any damage or losses as a result of a transaction made by a minor, boom2u reserves the right to seek compensation from the parents or legal guardians of the minor responsible for placing the order.

5. Placing Your Order

You may place an Order by adding items to “My Cart” on the Website and clicking the “Check Out” button. When you place your Order, we will issue you with an Order Number. By placing an Order, you make an offer to us to purchase the Products you have selected based on the Terms and Conditions applicable at the time of purchase. Information contained on this Website constitutes an invitation to treat. No information on this Website constitutes or should be deemed as an offer by us to supply any Products to you, however boom2u will make every effort to supply Products to you.

6. Shipping & Delivery Information

• Delivery will be carried out via GDEX, Pos Laju, or an alternative courier
• Shipping and handling feesare charged for each order.
• Orders will be shipped within 7 working daysfrom the date of purchase.
• Once your order has been dispatched, you will receive an email with the tracking number.

You are responsible for monitoring the delivery status of your order.
If your package is returned to us due to incorrect address, incomplete delivery, or any other delivery issue, you will be responsible for any additional postage and handling charges required to resend the item.

7. Important Delivery Notice

boom2u is not responsible for non-delivery due to incorrect delivery information provided at the time of purchase. If you need to amend your delivery address after placing an order, a processing fee of RM15.00 will apply. Additional postage charges may also be incurred if the goods have already been dispatched. 8. All Purchases Are Final

Please ensure that all items in your order are correct before proceeding to payment, as all purchases are final. We are unable to offer cancellations, exchanges, or refunds once a transaction has been completed.

If you receive a product that is defective, damaged, or incorrect, please contact us at admin@boom2u.com within 5 days of receiving your order. We will review your case and arrange for a replacement or appropriate resolution, where applicable.

1. Our Liability

In no event shall boom2u and any of its affiliates be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect, special, incidental or consequential loss or damage of any kind including but not limited to loss of use, loss of data, loss of business or profits, howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

2. Force Majeure

Neither boom2u nor any of its affiliates shall be liable for any failure or delay in performing any of its obligations under these Terms and Conditions if such failure or delay is caused by circumstances beyond their reasonable control and we shall be entitled to a reasonable extension of time for the performance of such obligations.

3. Entire Agreement

These Terms and Conditions together with your Order constitute the entire agreement between you and boom2u in relation to your use of the Website and the supply of the Products to you by boom2u. These Terms and Conditions cannot be varied except by us in writing or by e-mail. Neither you nor boom2u shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein. Unless specifically stated these Terms and Conditions supersede and replace all prior commitments, undertakings or representation, whether written or oral, between you and boom2u.

4. Modification/Alteration

We may at any time modify any relevant Terms and Conditions, policies or notices. You acknowledge that by visiting the Website from time to time, you shall become bound to the current version of the relevant Terms and Conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the Website.

These Terms and Conditions are binding upon the parties and their respective successors and permitted assigns.

These Terms and Conditions will not be assignable or transferable by you without our prior written consent.
